US Supreme Court Decides Stump v. Sparkman (1978)

Stump v. Sparkman is a leading US Supreme Court decision on judicial immunity. It involves a young woman who was suing a judge who had previously ordered her to be sterilized. The Supreme Court, in a 5-3 decision, reversed a prior Court of Appeals ruling, deciding that two criteria must be examined when determining whether an act warrants judicial immunity and holding that the judge could not be sued because he had acted within his jurisdiction. I remember reading a few years ago that the federal government, I believe, apologized to some ladies who had been sterilized in some Southern states some years previously.

Some people feel that sterilization is a good idea to prevent the birth of babies with serious mental problems who would present problems to themselves and to society.

A disgusting misuse of judicial power. Once again those in positions of great power cyoa (cover your own ass). Same old story, cops cover for cops, judge's cover for there own, politicians cover there own, physicians cover each other. Anyone with the enough power has the potential to do harm and if/when they do their peer's will circle the wagons if at all possible. It's all about self preservation. But some are worse than others, like judge's who can pass law's that won't allow citizens to sue them for their outrageous decisions. And we are powerless to stop them.

What was the real reason that led the mother to apply such a radical action?
A mother, almost always acts motivated by a loving concern for the integrity of her children.
The error of this judge was not to worry verifying if the grounds of the mother were honest and true.

Abominable.

It is not always the case that mother's work for the best interests of their children. No normal woman would have her 15 year old daughter's reproduction system whipped out; at that age the girl was not even fully developed. Appalling.

I agree with Henry's remarks... the powerful make their own rules up as they go along. I do believe that if WE all got together though we could put an end to the inequalities in society.

As the girl had no proper representation and was not informed of any of the decisions being made means that 'due process' was not being followed.

Has there ever been a case of a man who doesn't care about who he impregnates being sterilized? I doubt it very much.

A judge will not be deprived of immunity because the action he took was in error, was done maliciously, or was in excess of his authority. He will be subject to liability only when he has acted in the clear absence of all jurisdiction. What are those cases? when he takes a bribe; when he doesn't inform the jury of vital understanding. Any others?
