On the day of the accident, the minibus arrived at the farm road end at about 4.30 pm. It was dusk, approximately after sunset (witness used the word "gloaming"), and the light was fading.

That one morning while the deponent was in his service, the defender called on the deponent about four o'clock, and the deponent went into the kitchen, and found the defender eating a piece at the side of the dresser, and the pursuer was standing at the side of her bed with her clothes on; and when the deponent went into the kitchen, the pursuer ran out of it; and at this time it was before Whitsunday, and 'gloaming wise'.
