Usage: Premature babies often spend the postnatal period in the neonatal intensive care unit, where they receive specialized care.

In an emergency, or where a deviation from norm which is outside her current sphere of practice becomes apparent in the mother of baby during the antenatal, intranatal or postnatal periods, a practicing midwife shall call a registered medical practitioner or such other qualified health practitioner who may reasonably be expected to have the requisite skills and experience to assist her.

"Childbirth" includes the antenatal, intranatal and postnatal periods.
"Postnatal period" means the period after the end of labour during which the attendance of a midwife upon a woman and baby is required, being not less than 10 days and for such longer period as the midwife considers necessary.

In the Grand Duchy of Luxembourg the childbirth allowance is split into three instalments, namely the prenatal allowance, the childbirth allowance proper and the postnatal allowance. The first is granted when the mother to-be has undergone the last of the medical examinations required by the legislation. The second instalment of childbirth allowance is paid after the birth of a child, but only if three conditions are met: the birth must have taken place on Luxembourg territory, one of the parents must have been officially resident in the Grand Duchy for a year at the time of the birth, and the mother must have undergone the postnatal examination.

On certain, specified grounds, the Court of Justice of the European Communities declared that, by imposing residence requirements for the grant of childbirth and maternity allowances, the Grand Duchy of Luxembourg has failed to fulfil its obligations under Article 7(2) of Council Regulation (EEC) No 1612/68 of 15 October 1968 on freedom of movement for workers within the Community, and several other Articles of different Regulations and EEC Treaty.
