In 1793 year, in the case "The Duke of Montrose and Others (...)", it was decided that no length of possession can authorise any obstruction to the navigation of a public river.
In the background of the story, the masking-nets were installed. Certain hereditors down the river claimed a right of salmon-fishing, complaining about the injury done to their fishing, and the obstruction in the navigation of the river.

Every hereditor on the banks of a river, unless in so far as restrained by positive regulation, has a right of occupancy in the salmon it contains, which he may exercise as he thinks proper. The object of the enactments on this subject were not to regulate the rights of individuals. Their object was, as a matter of police, to prevent the breed of salmon from being destroyed; and so great was their fecundity, that provided the fry are preserved, there is no occasion, for this purpose, to take charge of the grown salmon.
