Any differences between them besides one being present tense and one being past tense? Please provide example sentences, analogies and elaborations for both phrases.

This is not usually present and past.

That is simple - it can be (now) or it could be (in the past) .

A common use of 'could' is not a as past tense, it is conditional, hypothetical, indicating uncertainty.
