Is reading her emails Hacking? Options

First off,in the US we have no anti-hacking law that would apply to this common messy divorce. As you know anything you write is going to be out there and easy for anybody to access. Being her ex she may be writing these E-mails to herself just to get him back for something he did to hurt her. If he's trying to show she's a adulteress or a unfit parent well these E-mails could help him. I don't think he's hacking anything,he may know her password or the phones are on the same account and he is getting the bill and seeing who she calls and text's. The only way a person would be arrested and charged would be if he were hacking into government sites,stealing private information. That would make him a threat to HOMELAND SECURITY and this would then be under Federal Jurisdiction. Bottom line here is "all is fair in love and war" !!
